Oil Spill Response Procedure (Agreement)

In order to prevent marine oil pollution for both parties, or to reduce the pollution level, we hope to reach an agreement of the following nature:
1. Both parties sign The People’s Republic of China ship pollution removal agreement and submit it to Dalian Maritime Safety Administration for reporting.
2. Contracted vessel must notify Dalian Shunfeng Shipping Service Co. Ltd ( Hereinafter referred to company) when crossing the reporting line of Port of Dalian, with notification including vessel’s name, gross tonnage, load condition, berth or terminal, types and quantity of cargo on board etc
3. Once the company receives the notification from the vessel, we will send our confirmation of the oil spill contingency ship’s name, position etc
4. Both parties agree to monitor VHF CH 06 or other channels and keeping smooth communication. The respective contact’s information is specified.
5. The two parties agree to periodically carry out oil spill drills.
6. When an oil spill occurs, taking action in according to following requirements:
1). Take immediate actions to block the spilling source or reduce quantity of spillage, control the scope of the oil spill, and reduce the level of pollution.
2). Report to Dalian MSA and company headquarters at the same time, the report should be as following:
A. Ship’s name, Flag state, Call sign or IMO number
B. Name and address of Ship’s owner, operator or governor; 
C. Time, position and relevant weather or sea state of the incident
D. General information of pollutants onboard, quantity, unloading position, etc
E. Extent of pollution;
F. The anti-pollution measures taken or ready to take, measures of cleaning, conditioned of controlled pollution（situation of pollution controlling）, and request for assistance.
G. Other items need to report in accordance with the relevant regulations.
3). Upon receiving the notification, we will arrange an oil spill contingency vessel in the shortest possible time, emergency supplies, apparatus and the emergency operation staff will arrive at the scene. Under the command of the experts， cooperating with the incident vessel to carry out the prevention of oil spreading, boom arranging, chemical treatment, physical retrieving on-site, and off-landing harmless treatment etc. We will also assess whether the on-site situation is controllable within our ability, or if any assistance needs to be provided.
4). The accurate data via the internet or in written form based off of the initial report will be sent from the vessel during the operation, which including the progress of the pollution cleanup and response actions being taken, etc. Finally, the written results in accordance with the initial and subsequent report will be submitted. 
5). Notify the company 3 hours before departure from the Port of Dalian. When contracted vessel sails out of the reporting line (Port of Dalian), notify the company via E-mail. We will reply by the same way, ‘Ship pollution removal agreement’ for the present voyage is ended.
